Privacy Notice for Job Applicants

This notice has been prepared by Akana Mühendislik ve Ticaret A.Ş. as data controller, pursuant to Article 10 of the Turkish Personal Data Protection Law No. 6698 (“the Law”) and the Communiqué on the Principles and Procedures to be Followed in Fulfilling the Obligation to Inform.

Candidates who wish to work at Akana Mühendislik ve Ticaret A.Ş. may apply to the openings published on www.akana.com.tr and on recruitment websites.

1. Personal Data You Share in the Application Form

  • Name, surname, gender, place and date of birth, education, marital status, dependants and criminal record information where applicable, the name and date of birth of first-degree relatives and their occupations; for the preparation of the personnel file should the candidate be employed,
  • Nationality; to determine whether a work permit application is required,
  • Contact numbers, e-mail address and related contact details; to contact the candidate,
  • Name, surname and contact details of the emergency contact person; to reach your relatives quickly and safely in an emergency,
  • Military service status; to determine whether anything may interrupt your employment,
  • Smoking, any health issues, operations, blood group, height and weight; to determine whether the health conditions required for the work are met and whether workplace conditions suit the candidate,
  • Education, work experience, audio data (call recordings), CV, foreign languages, computer skills, driving licence, internships, courses, seminars and conferences attended, membership of associations, foundations or unions, hobbies and similar information; to determine whether the candidate is suitably qualified,
  • Your answers and results in personality, aptitude, language and similar tests; to assess whether your skills fit the position applied for,
  • All information relating to references; to contact them, verify the data at hand and assess the suitability of the position,
  • Reason for leaving your last employer and records kept during the departure process where necessary; to determine whether our working conditions and the position suit you,
  • Position applied for, salary expectation, last net monthly salary, social and fringe benefits at previous employers, earliest start date and availability for overtime; to determine the role and position.

2. Purposes of Processing

Your personal data is processed primarily on the ground set out in Article 5/2(c) of the Law — processing being necessary for the conclusion or performance of a contract — for the following purposes: evaluating your application and carrying out human resources activities; conducting interviews and contacting you during recruitment; maintaining and developing internal activities; reviewing candidates and identifying new hires; determining your suitability for the position; recording your CV and contact details for future reference; verifying the references you provide; ensuring security within our organisation; ensuring activities are carried out in line with legislation and procedures; sending and evaluating personality and aptitude tests; our legitimate interests under Article 5/2(f); assessing your suitability for future opportunities should your application be unsuccessful; retaining your data for a reasonable period and informing you of potential opportunities; and use as evidence in any legal, administrative or financial dispute.

3. Transfer of Personal Data

Personal data may be transferred to third parties with the data subject’s explicit consent. Without explicit consent, transfers may take place where one of the conditions in Article 5/2 of the Law exists: where expressly provided for by law; where necessary to protect the life or physical integrity of a person unable to give consent; where directly related to the conclusion or performance of a contract; where necessary for the data controller to fulfil a legal obligation; where the data has been made public by the data subject; where necessary for the establishment, exercise or protection of a right; or where necessary for the legitimate interests of the data controller, provided the fundamental rights of the data subject are not harmed.

Special categories of personal data are processed and transferred within the framework of Article 6 of the Law. Data relating to health may only be transferred for the protection of public health, preventive medicine, medical diagnosis, treatment and care services, or the planning and management of health services, and only to persons or authorised bodies under an obligation of confidentiality.

Your data may be transferred, upon request and as required by legislation, to public prosecutors, courts and judicial authorities; to authorised public institutions; and where necessary to health institutions, laboratories, our business partners, private insurance companies, law firms, financial advisors and our consultants.

4. Methods of Collection and Legal Grounds

  • Through documents and information you send electronically (such as the CV you submit with an application made by e-mail or through the website),
  • Through your answers to personality and aptitude tests in electronic form,
  • Verbally through interviews with our employees or through the application forms you complete,
  • Where you provide references, by obtaining information from those persons on the basis of our legitimate interest.

5. Your Rights

Under Article 11 of the Law you have the right to: learn whether your personal data is processed; request information if it has been processed; learn the purpose of processing and whether the data is used in accordance with that purpose; know the third parties to whom the data is transferred at home or abroad; request rectification of incomplete or inaccurate data and notification of this to third parties; request erasure or destruction under the conditions of Article 7; object to a result arising against you from analysis solely by automated systems; and claim compensation for damage arising from unlawful processing.

6. Contact and Applications

You may submit your requests in writing in person to Başkent OSB 5. Cad. No:6 Malıköy Sincan Ankara, in accordance with Article 5 of the Communiqué on the Principles and Procedures for Applications to the Data Controller, or send them to the registered electronic mail address (kvkk@akana.com.tr), using a secure electronic signature, mobile signature or an e-mail address previously notified to the data controller and registered in our system.

Your application must include your name and surname (and signature if in writing); your Turkish ID number, or for foreign nationals your nationality, passport number or identity number; your residential or business address for notification; your e-mail address, telephone and fax number if any; and the subject of your request. Relevant information and documents should be attached.

We conclude the requests in the application free of charge, as soon as possible and within 20 days depending on the nature of the request. Where the process requires an additional cost, the fee set by the Personal Data Protection Board may be charged. We may accept the request in whole or in part, or reject it stating our reasons, and notify the data subject of the response through the contact details provided to us, in writing or electronically.
